TERMS AND CONDITIONS and DISCLAIMER

General

The terms and conditions below apply on registration for access and access to dmdu.com.au (the “Site”) and the DMDU Connect 2020 on July 31st – August 1st 2020 (the “Event”). Before completing your registration or purchasing your tickets with the Site or Events we ask that you read the terms and conditions set out below.

The Site and Event are owned by DMDU Pty Ltd [ ABN 28 622 814 135] (“DMDU PTY LTD”)
These terms may be amended without notice to you. Your continued use of the Site, the Events will mean that you accept these changes.

Advice

No information contained in the Site or provided at the Events should be deemed to constitute the provision of financial, investment or other professional advice in any way.

Content of the website, the events and the publication

By proceeding you agree, to the exclusion by us, of any liability, including without limitation that arising from any loss of profit or any other damage direct or consequential, in respect of any errors and/or omissions by us and/or any relevant third parties in respect of the content.
The contents of the Site, the Event(s) are based upon sources of information believed to be reliable, however, save to the extent required by applicable law or regulations, no guarantee, warranty or representation (express or implied) is given as to its accuracy or completeness and, the OMG Digital Group (including DMDU PTY LTD) and its members, officers and employees do not accept any liability or responsibility in respect of the information or any views expressed herein. If you have accessed the Site using a link from another site, DMDU PTY LTD does not accept any liability or responsibility for the accuracy of information contained within the sites of other providers who have links to any pages of this site or to whom this site is linked.

Registration

By registering your name and email address on the Site, you are agreeing to receive email communication from DMDU PTY LTD and other OMG Digital Group Entities to keep you informed of related products and services. Please see our privacy policy.

Notification

You agree to notify us of any changes to your personal circumstances with respect to any information or representation made herein and to provide us with any changes to this information as we may reasonably require.

Ownership and Copyright

The copyright in the website, the events and the publication (unless otherwise indicated), its contents, including all information, graphics, code, text and design are owned by DMDU PTY LTD and should not be reproduced or distributed without permission.

Admission Policy

Our events are open to professionals only. Solicitation of business or distribution of materials by non- exhibitors is strictly prohibited. Violators will be immediately removed from the show.

Any person found to be registering to attend our events using false information or credentials or deliberately withholding information will have their application automatically denied and may be liable to prosecution. Without prejudice, the organizers reserve the right to exclude any person(s).

Closed Circuit Television Cameras (CCTV) may be in operation at all times during the events. The organizers reserve the right to deliver the CCTV videotapes to the Police or other competent authority as evidence if requested to do so. The contents of such videotape may be used as evidence in a court of law.

DMDU PTY LTD reserve the rights to film/permit approved third party filming across the show open days of the events.

By attending the show, visitors permit the organizers/approved third parties to use any footage taken. Canvassing is not permitted.

The organizers reserve the right to exclude or remove anyone from the events or venue who does not comply with this policy or who they reasonably consider are likely to break the rules.

Day Cooling Off:

If you advise OMG Digital in writing within 10 days of signing this registration form (but not within 10 days of the event being held) that you do not wish to receive the Event Services this agreement shall be at an end and we shall refund to you all monies you have paid to us under this agreement within 14 days, except: (a) Any costs incurred in implementing the refund such as admin fees and bank charges.

Part Payments

For people participating in the Part Payment offer, the 10 day cooling off period commences from the 1st payment. After this, No refunds will be given. Should all payments not be made, then we reserve the right to refuse entry to the event.

Order Confirmation

Details of all successful and completed ticket purchase orders are sent to the purchaser (in the form of a confirmation page or email). If you do not receive this confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with the info@dmdu.com.au whether your order has been placed. Only you may be aware of any problems that may occur during the purchase process. DMDU Pty Ltd will not be responsible for losses (monetary or otherwise) if you assumed that an order was not placed because you failed to receive confirmation.

No physical tickets are sent out.

Proof of ID maybe required on the day of registration.

If purchasing a Student class of ticket you maybe asked for proof of eligibility to qualify for this class of ticket by way of valid and current student ID from a registered learning organisation or institution.

Cancellations & Refund Policy

Cancellations made within 10 day cooling off period will be eligible for a full refund. Cancellations received in writing more than one month prior to the start of the event will be refunded less a 50% cancellation fee. Cancellations received in writing within one month of the start date of the event will receive no refund and registrants will be liable for payment of 100% of the invoiced amount.

A substitute attendee can be named at any time before the event starts and no fees will be applied to this, this transfer of pass cannot be completed onsite. If your ticket is cancelled due to malpractice or misuse of discounts no refund will be issued (Please see discount conditions for more information on this). DMDU Connect reserves the right to refuse any refund based on management discretion.

Attendees will have a 48-hour period after purchasing an add-on to apply for a refund after that time no refund will be given. Once the recordings are available, the 48-hour period becomes invalid and all add-on purchases will gain immediate access. For that reason, refund requests will no longer be eligible.

Cancelled, Postponed or Rescheduled Events

The Event may be cancelled, or postponed by DMDU PTY LTD (the “Affected Party”) in circumstances where it is no longer possible, practical or economical to hold the Event due to events beyond the reasonable control of the Affected Party or other situations which may affect the performers, staff or audience (“Force Majeure Event”). A Force Majeure Event can include, but is not limited to:

a) acts of God, including storms or cyclones, action of the elements, epidemics, pandemics, landslides, earthquakes, floods, fire, road or rail closures due to washouts or impassability and natural disaster;

b) strikes, stoppages, restraints of labour, or other industrial disturbances;

c) acts of the public enemy, including wars which are declared or undeclared, blockades
and insurrections;

d) riots, malicious damage, sabotage and civil disturbance;

e) accident (including accidental emissions of pollutants or hazardous substances), fire,
explosion, radioactive contamination and toxic or dangerous chemical contamination;

f) the adverse application of any laws;

g) actions or decrees of any Commonwealth or State government, court or governmental agency
not resulting from any wrongful act or omission of the Affected Party;

h) the refusal of or delay in obtaining any necessary consents from any government agency, provided that the Affected Party has acted in a timely manner in endeavouring to secure them;

i) the failure by any third party supplier of its obligations to supply goods or services to the Affected Party, provided that the Affected Party has acted in a timely manner in endeavouring to secure such supply, and provided that the Affected Party itself is not in breach of any relevant obligation; and

J) any production shutdown or interruption which is validly required or directed by the Commonwealth or State government or any governmental agency which is not due to the act or default of the Affected Party,

If a live event is cancelled, DMDU PTY LTD may elect to provide ticket purchasers with access to a pre-recorded or live-streamed event with similar content and speakers as the original event and ticket purchasers will not be entitled to a refund.

If a live event is cancelled and DMDU PTY LTD does not elect to provide access to a pre-recorded or live-streamed event in lieu of the live event, DMDU PTY LTD will use reasonable endeavours to notify ticket purchasers of the cancellation and will request ticket purchasers to please contact DMDU PTY LTD for information on receiving a refund.

Refunds for tickets purchased prior to the date of the cancelled event will be given up to the amount paid for the tickets (including per transaction handling fees) but will normally exclude any delivery fees paid in respect of the tickets. Depending on the circumstances in each case, a partial refund may be given where one day of a multi-day event is cancelled. Contact DMDU Connect for exact instructions if an event is cancelled or rescheduled. Please make sure to include/provide your order details so we can expedite your refund (if applicable).

If an event is rescheduled, ticket purchasers will be offered seats at any rescheduled event up to the face value of the original tickets or, if the ticket purchaser is unable to attend the rescheduled event or the event is not rescheduled, a refund on application to DMDU PTY LTD.

It is your responsibility to ascertain whether an event has been cancelled and/or rescheduled and the date and time of any rescheduled event. If an event is cancelled or rescheduled, DMDU PTY LTD will use reasonable endeavours to notify ticket purchasers of the cancellation or details of the rescheduled event. DMDU PTY LTD does not guarantee that ticket purchasers will be informed of such cancellation or rescheduling before the date of the event.

Discounts & Codes

Discount codes cannot be combined with any other offers or credit received from a previous show. Any credit issued must be used by the original recipient and cannot be transferred.

Discounts cannot be retroactively applied to a completed ticket purchase. Additionally, refunds or credits cannot be issued of equivalent value to any offered discounts or promotions. Complimentary upgrades are considered on a show-by-show basis at the discretion of the DMDU Connect team. DMDU Connect does not guarantee an upgrade is applicable and DMDU Connect retains the right to decline upgrade requests at any time, for any reason at its discretion. Early bird pricing windows (including Super Early Bird, Early Bird, and Just in Time price tiers) are final unless otherwise adjusted by an active promotion. After the pricing window has closed, the expired rate will no longer be made available and cannot be retroactively applied.

If an attendee is found using a discount code that was not provided for the code’s intended use, the purchasers ticket will be cancelled, and no refund will be issued. Group registrations using a group or bulk discount will not be eligible for a refund. Registration transfers will still be valid on the passes up to one month before the show. DMDU Connect discounted tickets are not eligible for resale. Any resold tickets will be immediately considered void and ineligible for a refund.

Tickets and Add-ons are subject to individual promotions and cannot be combined or redeemed against one another.

Any discount provided for these add-ons will not be applicable after a purchase transaction has been completed. Discounts must be applied before purchase confirmation when selecting available products.

Tickets distributed as part of a sponsorship package are applicable exclusively to the contracted company. Complimentary tickets will only be valid for said company unless otherwise specified by a member of the DMDU Connect team. Discount codes cannot be redeemed onsite at the event.

Live Events

The events, information, and speakers listed on our Sites are subject to change without notification.

Unused tickets/passes will be forfeited and are not transferable to another event. TICKET HOLDERS MAY NOT SELL, OFFER FOR SALE, OFFER AT AUCTIONS, RESELL, DONATE, ACT AS COMMERCIAL AGENT FOR ANOTHER PARTY OR OTHERWISE TRANSFER THEIR TICKETS IN ANY WAY WITHOUT THE SPECIFIC PRIOR WRITTEN CONSENT OF DMDU PTY LTD.

Ticket Transfers

Ticket/pass transfers will not be processed THIRTY (30) Days prior to the event and a $50 transfer fee will be applied to all ticket/pass transfers. Process for Guest Tickets Transfers

Once a ticket/registration is confirmed, you may only change the assignment of the guests accompanying you a maximum of 2 times by submitting a Guest Ticket Transfer Request. You must submit a transfer request to: info@dmdu.com.au

Ticket Resales

If you cannot use all of the tickets/passes that you have purchased, you will have the opportunity to submit to DMDU PTY LTD a formal request for the resale of the tickets/passes you no longer want via the Event support team so that the support team can try to resell the tickets/passes to another attendee.

There is no guarantee that demand for tickets/passes will result in the tickets being resold. If your tickets/passes are not resold, no resale proceeds will be refunded.

Recordings

Show recordings purchased at or after the show can be subject to a development retainer and can take up to 8-12 weeks from the end of the show to be available for attendees to view. In the case of an unforeseen circumstance, DMDU Connect reserves the right to extend this time period without notice, and there will be no changes to the refund policy if this occurs.

As per our refund policy, there will be a 48-hour period after the purchasing of any recordings to apply for a refund. After that time the recordings will no longer be eligible for a refund. Once the recordings are available, the 48-hour period becomes invalid and all attendees purchasing recordings will gain immediate access and for that reason will not be eligible for any refunds.

All refunds must be submitted in written format to the support team.

Live-Streams

Refunds will only be provided in situations where the customer is unable to watch the Live-stream due to technical issues. Refunds will only be considered and processed on the first day of each respective Event.

LIMITATION ON LIABILITY

THE DMDU PTY LTD STREAM AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE EVENT LIVE STREAM, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. DMDU PTY LTD DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE DMDU PTY LTD LIVE STREAM WILL BE UNINTERRUPTED OR ERROR-FREE.

DMDU PTY LTD is not responsible for any problems or technical malfunction of any network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or redemption to be received by DMDU PTY LTD on account of technical problems or traffic congestion online or on the Internet or at any Web site, or any combination thereof including any injury or damage to customer’s or any other person’s computer related to or resulting from downloading or streaming any materials consistent with this agreement or subsequent use of any DMDU PTY LTD owned web properties. If, for any reason, the stream is not capable of running online as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of DMDU PTY LTD which threatens or corrupts or adversely affects the administration, security, fairness, integrity or proper conduct of a live stream offer, DMDU PTY LTD, reserves the right, in its sole discretion, to cancel, terminate or suspend the offer and/or any subscription. ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, DMDU PTY LTD WILL DISQUALIFY YOUR ATTEMPTED REDEMPTION AND RESERVES THE RIGHT TO SEEK DAMAGES FROM YOU TO THE FULLEST EX
